Terms and conditions of sale

These General Conditions of Sale govern purchases made through the online store of Azienda Agricola Il Ruscello di Nenna Guido by customers, hereinafter referred to as "Customer".
These Terms may be updated or modified. The changes will take effect from the date of their publication on the site and will not affect orders already concluded.
Distance sales to consumers are governed by Legislative Decree. 206/2005 (Consumer Code) and subsequent amendments, as well as by the Italian and European legislation applicable to electronic commerce and consumer protection.

ARTICLE 1 – Subject of the contract
With these General Conditions of Sale, Azienda Agricola Il Ruscello di Nenna Guido sells and the Customer buys remotely the products indicated and offered for sale on this site.
The contract is concluded through the internet by accessing the Customer to the site and sending an order according to the expected purchase procedure.
The essential characteristics of the products are reported in the respective product sheets. For food products, the Customer is invited to carefully consult the information relating to denomination, ingredients, allergens, nutritional values, quantities, storage and any other available indication.
ARTICLE 2 – Conclusion of the contract
Before the conclusion of the purchase, the Customer can check the contents of the cart, the selected products, the quantities, the prices and any additional costs.
Sending the order involves the obligation to pay.
Following the submission of the order, the Customer will receive at the e-mail address indicated a confirmation containing the main information related to the purchase.
The Customer is required to verify the correctness of the data communicated and to promptly report any errors.
Product photographs are for illustrative purposes. Any slight differences in color, appearance, packaging or presentation that do not affect the essential characteristics of the product do not constitute a defect of the product.
ARTICLE 3 – Availability of products
The availability indicated on the site refers to the situation present at the time of the consultation.
Due to the possible simultaneous presence of several users on the site, the unavailability of a product may exceptionally occur after sending the order.
In this case, the Customer will be informed promptly and will be able to choose, where possible, between the solutions proposed by the Seller or obtain a refund of the sums paid in relation to unavailable products.
ARTICLE 4 – Prices
All prices are expressed in euros (€) and are those displayed on the site at the time of purchase.
Any shipping costs are not included in the price of the product and are calculated according to the weight, destination and characteristics of the order.
The total amount due, including any additional costs applicable, is shown to the Customer before the final confirmation of the order.
The Seller can change the prices of the products at any time. Changes do not apply to orders already concluded.
ARTICLE 5 – Payment methods
The Customer can make the payment using the methods available in the checkout of the site.
Among the accepted payment methods may be available:
Credit and debit cards;
Shop Pay.
The actual availability of each method is shown during checkout.
Payment data is managed through the payment systems and providers used by the online store according to the relevant security measures.
ARTICLE 6 – Shipments
Shipments are made in Italy and in European countries enabled on the online store.
Orders are normally prepared for shipment within 2-3 working days of order confirmation, except for periods of particular attendance, holidays, unavailability or causes beyond the control of the Seller.
The order preparation times do not coincide with the courier's transport times.
The courier used may vary depending on the weight, destination, size and characteristics of the shipment.
The shipping cost is calculated on the basis of the order and shown to the Customer before payment.
The Customer is responsible for the correctness and completeness of the delivery address indicated in the order.
ARTICLE 7 – Billing
For purchases for which, according to the applicable legislation, there is no obligation to issue the invoice unless requested by the Customer, the invoice is issued at the request of the Customer, subject to communication of the data necessary for invoicing within the terms provided for by the legislation.
The Customer who needs the invoice is therefore invited to communicate it at the same time as the purchase and to provide complete and correct data.
The tax provisions applicable to individual transactions remain unchanged.
ARTICLE 8 – Right of withdrawal
Subject to the exceptions provided for by law, the Customer who holds the status of consumer has the right to withdraw from the contract without having to provide any reason within 14 days from the day on which he acquires physical possession of the goods.
To exercise the right of withdrawal, the Customer must unequivocally communicate his decision to withdraw from the contract by contacting:

The communication must make it possible to identify the order and the products subject to the withdrawal.
ARTICLE 9 – Return of products
Following the valid exercise of the right of withdrawal, the Customer must return the products according to the instructions provided by the Seller and within the terms provided for by the applicable legislation.
The direct costs of returning the products are borne by the Customer, except in the case of incorrect, damaged or non-compliant products attributable to the Seller or other cases in which the law provides otherwise.
The Customer is responsible for the decrease in the value of the goods resulting from handling other than that necessary to establish their nature, characteristics and operation, within the limits provided for by law.
ARTICLE 10 - Exceptions to the right of withdrawal for food products
The right of withdrawal cannot be exercised in cases of exclusion provided for by applicable legislation.
In particular, in the cases provided for by law, the right of withdrawal may be excluded for:
Goods likely to deteriorate or expire quickly;
Sealed goods that do not lend themselves to being returned for hygienic or health protection reasons and that have been opened after delivery;
Additional products falling within the exceptions provided for in art. 59 of the Consumer Code.
The simple food nature of the product does not automatically entail the exclusion of the right of withdrawal.
ARTICLE 11 - Refund in case of withdrawal
When the right of withdrawal is validly exercised, the Seller will reimburse the sums due in the manner and within the terms provided for by the applicable legislation.
The refund will be made, unless otherwise agreed, using the same means of payment used by the Customer for the initial transaction.
The Seller may withhold the refund in the cases and within the limits permitted by law until the receipt of the returned goods or until the Customer has demonstrated that he has sent them back.
ARTICLE 12 – Damaged, incorrect or non-compliant products
If the Customer receives a damaged product, different from the one ordered or non-compliant, he is invited to promptly contact the Seller at the address:

Indicating the order number and providing, when necessary, photographs of the product received and the packaging.
The Seller will manage the report in compliance with the rights recognized to the consumer by the applicable legislation.
These provisions do not in any way limit the mandatory rights granted to the consumer.
ARTICLE 13 - Conservation of foodstuffs
The Customer is required to respect the storage methods and temperatures indicated on the packaging and/or in the product sheet.
Once the package is opened, any specific instructions regarding storage and consumption on the label must be followed.
The Seller is not responsible for the deterioration of the product resulting from storage methods that do not comply with the indications provided, without prejudice to the mandatory rights of the consumer.
ARTICLE 14 – Responsibility
The Seller is not responsible for delays or defaults due to force majeure events or other circumstances that are not reasonably controllable, without prejudice to the mandatory rights granted to the consumer.
Nothing in these Terms shall be construed as an exclusion or limitation of liability in cases where such exclusion or limitation is not permitted by law.

ARTICLE 16 – Privacy and processing of personal data
The personal data provided by the Customer are processed in compliance with Regulation (EU) 2016/679 (GDPR) and the applicable national legislation.
For complete information on the methods and purposes of the processing of personal data,the Customer can consult the Privacy Policy available on the site.
ARTICLE 17 - Applicable law and competent court
These General Conditions of Sale are governed by Italian law, without prejudice to the possible right of the consumer resident in another country to benefit from the mandatory protection provisions provided for by applicable law.
For disputes with a Customer who has the status of consumer, the mandatory provisions on territorial jurisdiction provided for by current legislation apply.
ARTICLE 18 – Validity of the conditions
Any nullity or ineffectiveness of a single provision of these Conditions does not result in the nullity or ineffectiveness of the remaining provisions.
The Seller may modify these Conditions. The version applicable to the purchase is the one in force at the time of the conclusion of the order.
